In 1996 HB amendment regulations were introduced to maximise Housing Benefit payments via the determination of the rent officer and more latterly by the Local Housing Allowance (LHA). The Exempt Accommodation (EA) definition was created at that time to protect supported housing from the maximum Housing Benefit rules. EA has been protected/exempted from all subsequent Housing Benefit amendments and restrictions over the last 20 years. It has, indeed, been protected from Universal Credit which is the most significant change in welfare reform since its creation. This indicates and evidences the Government’s commitment to protect people in receipt of care and support from any restriction in their housing costs as they acknowledge the greater burden placed upon the landlord in respect of the cost of managing, maintaining and delivering housing related services in supported housing environments.
